Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Dukaan Buddy Technologies Pvt. Ltd.("DukaanBuddy") governing your access to and use of dukaanbuddy.com, seller.dukaanbuddy.com, and related mobile applications (collectively, the "Platform"). By creating an account or using the Platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Platform. Sellers must provide accurate business, tax, and bank details.

2. Buyer Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• Orders are subject to product availability and seller confirmation.
• Prices, taxes, and delivery charges are displayed at checkout before you confirm an order.

3. Seller Accounts

• Sellers must hold a valid GSTIN where required by law and list only lawful, accurately described products.
• Sellers are independent third parties; DukaanBuddy is a marketplace facilitator and is not the manufacturer or seller of record unless explicitly stated.
• Sellers agree to fulfil orders within the timelines committed at listing and to honour the Return Policy and Buyer Protection guarantee.
• Continued use of seller tools is also governed by the Seller Agreement.

4. Prohibited Conduct

You may not use the Platform to list counterfeit, illegal, or restricted goods; manipulate reviews or ratings; circumvent fees; scrape data; or interfere with the security or operation of the Platform.

5. Payments and Fees

Buyers pay through supported payment methods at checkout. Sellers are charged platform commission and payment gateway fees as disclosed in their seller dashboard and the Pricing page; payouts are processed per the seller's chosen payout cycle, subject to successful delivery and the return window.

6. Returns, Refunds, and Cancellations

Return and refund eligibility is governed by our Return Policy and, for eligible orders, the Buyer Protection guarantee. Sellers agree to process approved returns and refunds within the timelines specified in the Seller Agreement.

7. Intellectual Property

The DukaanBuddy name, logo, and Platform software are owned by Dukaan Buddy Technologies Pvt. Ltd.. Sellers retain ownership of their product content but grant DukaanBuddy a licence to display it on the Platform and in marketing.

8. Limitation of Liability

To the maximum extent permitted by law, DukaanBuddy is not liable for indirect, incidental, or consequential damages arising from use of the Platform, transactions between buyers and sellers, or third-party courier delays.

9. Suspension and Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose a risk to other users, with notice where reasonably possible.

10. Governing Law and Disputes

These Terms are governed by the laws of India. Disputes shall be subject to arbitration in Hyderabad, Telangana under the Arbitration and Conciliation Act, 1996, and the courts of Hyderabad shall have exclusive jurisdiction over matters not subject to arbitration.

11. Changes to These Terms

We may revise these Terms periodically. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
